WARRANTY TERMS

Dyacon warrants to their customers that their terminal products (with exception of normal wear items such as batteries, cables, keyboard and backlight) will be free from defects in material, fabrication, and workmanship and will perform and function in accordance with the specifications for a period of twelve (12) months after shipment. Dyacon will replace or repair mal-or non-functioning products during the warranty period, provided however, Dyacon shall not be obligated to repair or replace at its expense terminal products that are damaged or defective due to misuse by the user.

Dyacon shall provide maintenance service at its facilities or at designated service centers. During the warranty period of each piece of equipment, with the exception of shipping costs, this maintenance shall be provided at no cost to customers. After the warranty period, maintenance service shall be made available as an option in accordance with current Extended Warranty Rates.

The product warranties set forth above are in lieu of all other warranties of Dyacon, whether written, oral, or implied. Dyacon makes no other warranties regarding its products (hardware or software), including without limitation warranties as to merchantability, fitness for a particular purpose, any warranty arising from course of performance, course of dealing or usage of trade whether any of the forgoing warranties are either expressed or implied.

Removal of the original serial number label from a piece of equipment will void any warranty. Dyacon will not be responsible to repair or update equipment if the said serial number label has been altered or removed. Dyacon products have no internal user-serviceable parts. If the product is opened or in any other way tampered with, all warranties are null and void.
